Gazette No. 22 — Land Registry — Establishment

Be it known and placed on record: That the Land Registry of the Mohawk Nation of Grand River Secretariat is hereby established as the authoritative record of the Secretariat’s interests in lands within the Mohawk Acquired Territory, and that the Notice of Interest Register is established as the sub-register for Notices of Interest filed with respect to specific parcels.

I. The Seven Prior Notices

Between 2017 and 2022, the Secretary-General filed seven Notices of Interest with the Director of Titles, ServiceOntario, with respect to parcels within the Grand River corridor. The Director of Titles was copied directly in each case. The administrative response to all seven Notices was zero.

The Red Cross building at 25 William Street, Brantford — one of the parcels subject to a Notice of Interest — was demolished in July 2024. This occurred three years after the Director of Titles was placed on direct notice of the Secretariat’s interest in that parcel.

II. The Administrative Gap

Director Dan Petoran of the Land Registry Services Branch, ServiceOntario, confirmed in writing on 1 April 2026 that no mechanism exists in Ontario’s land titles system to record or give effect to the Haldimand Crown covenant interest. This confirmation constitutes a ministerial admission of an unconstitutional administrative gap.

III. The Mandamus Application

The Application for Writ of Mandamus (G63) seeks an order from the Ontario Superior Court of Justice directing the Director to establish an indexed external notice record for the Haldimand Crown covenant interest. The Land Registry established by this Gazette will be the Secretariat’s parallel record, operational regardless of the mandamus outcome, and will provide the evidentiary basis for all subsequent Notice of Interest filings.
