Gazette No. 23 — Trust Registry

Be it known and placed on record: That the Trust Registry of the Mohawk Nation of Grand River Secretariat is hereby established as the authoritative record of all trust instruments, trust accounts, and trust arrangements for the benefit of the Haldimand Beneficiary Class.

The Trust Registry records: the Haldimand Lands Trust Account (G25); the BlueBelt + Grand River Land Trust (G59, G60); all trust instruments issued under the TIN001 series; and all beneficial interests held on behalf of the Haldimand Beneficiary Class.

All persons occupying, using, or deriving benefit from lands within the Haldimand Acquired Territory without addressing the Haldimand constitutional encumbrance occupy the position of trustee de son tort — persons who have intermeddled with the trust property without authority and who hold any benefit derived from that property on constructive trust for the beneficiaries. The Trust Registry is the institutional record establishing the beneficiaries on whose behalf those constructive trusts arise.
