Gazette No. 51 — Grand River Location Determination Rules (MNLDR)

Be it known and placed on record: That the Grand River Location Determination Rules (MNLDR) are hereby established, governing the determination of whether any parcel, property, or location falls within the Mohawk Acquired Territory as defined by the Haldimand Proclamation of 25 October 1784.

I. The Boundary Test

The Haldimand boundary test is applied as follows: a parcel falls within the Mohawk Acquired Territory if any portion of that parcel falls within six miles of either bank of the Grand River, measured from the centreline of the river, at any point from the river’s mouth at Lake Erie to its source in Dufferin County.

II. Location Determination Certificates

Upon application of the boundary test, the Surveyor General’s office issues a Location Determination Certificate (LDC001) for each parcel, stating: the parcel identifier (PIN); the result of the boundary test (within / outside / partially within); the encumbrance notation; and the Notice of Interest (NOI001) reference number.

III. The Post-Mandamus Programme

Upon activation of the Post-Mandamus Programme Directive (G71, Program 1 — Parcel Automation), the Surveyor General’s office will apply the boundary test to every PIN within the corridor and issue LDC001 certificates and NOI001 notices for all parcels found within the Territory. This is the mechanism by which the mandamus order translates into constructive notice for all affected landowners.
